WHAT ARE THE DIFFERENT TYPES OF CHAPTERS IN BANKRUPTCY?

Most commonly used are Chapter 7, 11 and 13

Chapter 7 is probably the most commonly used of all 3 mentioned because it is considered a 'straight' bankruptcy and because it causes the greatest amount of debt relief.  

Chapter 11 is usually used by corporations or big businesses; although individuals can also file for Chapter 11.  With Chapter 11, there are no liquidation of assets and removal of debt; rather, the debts and assets are reorganized into a repayment plan.  If you own a business, under Chapter 11 you can continue operation.

Chapter 13 is for individuals; it is similar to a debt consolidation, but is done through a court system; but most importantly it protects your home, your retirement and belongings to say the least.

QUICK NOTE ON UNDERSTANDING A PERSONAL INJURY CLAIM

At the Law Office of Mark Williams we generally see two types of injury cases, we have the obvious severely injured and the injured who don't know they are injured until a couple of days after the accident.

The cases where our clients have severe injuries, they are so severe they are taken from the scene of the accident in an ambulance with broken bones; or injuries that require surgery and/or require an extended stay in the hospital.

The type of injury that may or may not be apparent immediately is usually the cases where our client has suffered soft tissue injuries. Soft tissue injuries can consist of strained or sprained muscles, tendons and ligaments.

It is much harder to prove that soft tissue injures were actually caused by the accident than the severe injuries - the medical care that you receive is an extremely important part of your personal injury case.

Foremost, without medical care that documents and supports your injury claim, you will not have any injury claim. Without the medical care and its corresponding documentation the insurance company will, without a doubt take the position that you were not hurt.

I'VE BEEN IN AN AUTO ACCIDENT! NOW WHAT?

If you have a driver license, it is likely that at least once in your lifetime you will be in an auto accident. Here are five immediate tips you can do to help protect yourself or your loved ones.

#1 - Get as much information as you can. Don't just rely on the police to document everything for you; even if you are hurt and do not require immediate medical attention.

#2 - Photograph, Photograph, Photograph! Take photos of all cars involved; especially before the vehicles are moved. This can help prove later on that the accident happened the way you say it happened. Also photograph your visible injuries; this can be important later when your visible injuries have already healed.

#3 - Gather Witness Contact Information - A non-biased witness can be important in proving your side of the accident. The other driver has their own version of what happened, having a witness can be helpful with strengthening your case.

#4 - Get the other driver's personal contact information and their insurance carrier's name and policy number. (see #1)

#5 - Most importantly, go get medical attention if you've been hurt. You don't have to 'tough it out'- if you're hurt, seek medical help.
