Debt Settlement–Yet Again?

Recently, I’ve seen commercials on television for yet another debt settlement company.

The tagline for this particular debt settlement company is that “you have the right to settle your credit card debt. That’s good news for you; bad news for the credit card company.”

My reaction is that I cannot believe yet another company that will soon find itself in trouble for bilking consumers out of thousands of dollars is making yet another big advertising push.

You do not have a “right” to settle your debt with credit card companies. I suppose, technically, you have the right to make an offer and they have a right to say, “no!”
Bankruptcy is a federal program that is designed to help the hardworking people of America not swindle them into a downward spiral of being further in debt with a program that isn't designed to help people but to rather, help themselves.

Payday Loans: Myths and Facts!

More often than not these days, the clients I see who are considering bankruptcy have taken out one or more Payday Loans.

Generally speaking, a Payday Loan (also referred to as a Cash Advance Loan) is a small loan that at least in theory, is paid off by the borrower’s next payday.

The borrower goes to the Payday Lender, gives the lender some proof of actual employment, and then gives the lender a postdated check for the amount they want to borrow plus the fee  for the amount they borrow.  The lender then gives the borrow the money, less the fee and agrees to hold the check until the borrower’s next payday.

When the loan becomes due at the next payday, the lender either deposits the check (often the borrower agrees to permit the lender to automatically withdraw from the borrower’s bank).
So, what happens when payday rolls around and you need the money for something else?

Well, your friendly Payday Lender agrees to hold the check until the next payday, for an additional fee.

Borrowing money this way is expensive.  How expensive?

The Federal Trade Commissions, Bureau of Consumer Protection provides an excellent example, pointing out that if you borrow $100.00 from a Payday Lender with a charge of $15.00 and roll the loan over once for another $15.00 fee and then pay off the loan, you just paid 391% interest to borrow $100.00 for a month.

The reality is that most Payday Loans are for a range of $300.00 to as high as $500.00 with much higher fees.

What can and can’t a Payday Lender do if you don’t pay back the loan?

One Thing They Can’t Do Is Put You In Jail!
At least they probably can’t!  Why can’t they?

Because when the Payday Lender takes a post dated check it knows that the money is not in the bank.
If you go to a store and knowingly write a bad check, that is a crime, and if a District Attorney can prove that you wrote the check knowing that you didn’t have the money in your bank account you will be fined, and even perhaps go to jail.

This is because of what you intended to do when you wrote the check.

The store owner had every reason to believe the check was good, the Payday Lender does not.

The Payday Lender Knows It Is Taking  A Bad Check and you wrote the check with every intent on paying back the loan.

It is unlikely the a DA will ever accept charges for a bad check under these circumstances.
I should point out that if someone were to write a check to cover a Payday Loan and then immediately close the checking account, that the DA might look at the issue a little more closely.

What Can A Payday Lender Do?
  • They can call you to demand payment.  Repeatedly and relentlessly!
  • They can simply attempt to cash the check, or if they have authority to automatically withdraw the money, they will, with the likely result of overdrawing your checking account.
  • They can sue you, and get the amount owed, court costs interest and attorney’s fees.
  • They can garnish your wages once they have a judgment.
  • They can turn the debt over to a debt collector.
Very rarely does someone go to a Payday Lender as their first borrowing source.  Payday loans are often a sign that an individual is in a bad financial situation.

Payday loans can be discharged in bankruptcy!

How will my bankruptcy affect my spouse’s credit?

Your spouse’s credit may not be affected by filing a bankruptcy unless you owe money jointly with your spouse or your spouse has not benefited from a loan or credit card; as Guam governs under a community property and community debt law.

Furthermore, if you and your spouse jointly owe a debt that remains current, your spouse’s credit may not be impacted.

Understanding Joint Debt

Often, clients are unsure whether they have any joint spousal debt. The key is whether both spouses agreed to be liable. A person is liable for a debt only if he signs an obligation such as a revolving credit card application or a financing agreement.

The possible impact a bankruptcy would have on a joint debtor is one of the many factors in determining the best course of action. An experienced bankruptcy lawyer, such as Attorney Mark Williams can analyze the “big picture,” and help guide a debtor through such financial considerations.

ROBBING PETER TO PAY PAUL?
Let’s Talk about Bankruptcy - Part 1

Most people think of Bankruptcy as the end of their financial borrowing life.  We've heard, "Oh, I won't be able to buy a house or a car or get loans again".  This simply is not true.  Bankruptcy is a federal program that is designed to help you.  It's about protection; you just have to file the right chapter that is going to be most beneficial to you.  Attorney Mark Williams can help you; he's been helping people and businesses get financially on track for over 25 years; he can do the same for you.

WHAT ARE THE DIFFERENT TYPES OF CHAPTERS IN BANKRUPTCY?
Most commonly used are Chapter 7, 11 and 13

Chapter 7 is probably the most commonly used of all 3 mentioned because it is considered a 'straight' bankruptcy and because it causes the greatest amount of debt relief.

Chapter 11 is usually used by corporations or big businesses; although individuals can also file for Chapter 11.  With Chapter 11, there are no liquidation of assets and removal of debt; rather, the debts and assets are reorganized into a repayment plan.  If you own a business, under Chapter 11 you can continue operation.

Chapter 13 is for individuals; it is similar to a debt consolidation, but is done through a court system; but most importantly it protects your home, your retirement and belongings to say the least.

QUICK NOTE ON UNDERSTANDING A PERSONAL INJURY CLAIM

Feeling like you got hit by a Mack Truck?
At the Law Office of Mark Williams we generally see two types of injury cases, we have the obvious severely injured and the injured who don't know they are injured until a couple of days after the accident.

The cases where our clients have severe injuries, they are so severe they are taken from the scene of the accident in an ambulance with broken bones; or injuries that require surgery and/or require an extended stay in the hospital.

The type of injury that may or may not be apparent immediately is usually the cases where our client has suffered soft tissue injuries. Soft tissue injuries can consist of strained or sprained muscles, tendons and ligaments.

It is much harder to prove that soft tissue injures were actually caused by the accident than the severe injuries - the medical care that you receive is an extremely important part of your personal injury case.

Foremost, without medical care that documents and supports your injury claim, you will not have any injury claim. Without the medical care and its corresponding documentation the insurance company will, without a doubt take the position that you were not hurt.

I'VE BEEN IN AN AUTO ACCIDENT! NOW WHAT?

If you have a driver license, it is likely that at least once in your lifetime you will be in an auto accident. Here are five immediate tips you can do to help protect yourself or your loved ones.

#1 - Get as much information as you can. Don't just rely on the police to document everything for you; even if you are hurt and do not require immediate medical attention.

#2 - Photograph, Photograph, Photograph! Take photos of all cars involved; especially before the vehicles are moved. This can help prove later on that the accident happened the way you say it happened. Also photograph your visible injuries; this can be important later when your visible injuries have already healed.

#3 - Gather Witness Contact Information - A non-biased witness can be important in proving your side of the accident. The other driver has their own version of what happened, having a witness can be helpful with strengthening your case.

#4 - Get the other driver's personal contact information and their insurance carrier's name and policy number. (see #1)

#5 - Most importantly, go get medical attention if you've been hurt. You don't have to 'tough it out'- if you're hurt, seek medical help.

Why Hire a Personal Injury Lawyer in Guam?

One of the most frequent questions we get asked is whether or not you need to hire an attorney when you’ve been hurt in an accident that was no fault of your own.  The answer is, yes.

Most people are honest and trustworthy; so they are assuming that insurance companies or even the party at fault will also be honest and trustworthy; but the truth of the matter is that you need a lawyer to help protect your rights.  Ask yourself this, is the other party or their representatives going to protect your interests or their own?

At The Law Office of Mark Williams - We keep the Law on your Side!
